Residence permit for caring parents of EU children
The ‘Chavez residence permit’ (residence as a caring parent of a minor Dutch child) was already considered a ‘non-temporary’ right of residence by the IND.
The IND recently determined in an information report that two other categories of residence permits will also receive the status of ‘non-temporary’. These are also residence permits that have been issued to parents who live in the Netherlands with a child with EU nationality. These are:
- Residency as a caring parent with a minor EU citizen (non-Dutch): If a parent cares for a minor EU child, this parent is entitled to reside in the Netherlands based on their child’s right to reside in the EU.
- Residency with a minor child who goes to school on the basis of Article 10 of Regulation 492/2011: If a parent resides with a child with EU nationality who is attending school in the Netherlands, this parent is allowed to reside in the Netherlands with them.
What does this mean in practice?
This means that the residence of parents and guardians based on one of the above-mentioned situations is no longer considered ‘temporary’. This makes it possible for these persons to apply for a residence permit for EU long-term residents, or a permanent residence permit, or Dutch nationality. This change has now also been implemented in the relevant laws and regulations.
